The Deprivation of Liberty Procedures: Safeguards for Whom?

The Deprivation of Liberty (DoL) procedures under the Mental Capacity Act 2005 have caused confusion and controversy since their introduction five years ago.

Both members of the public and professionals are unclear over when a patient is entitled to the safeguards, and this may be a contributing factor to the wide variation across England and Wales in its use by health and social care professionals and lawyers.

A National Conference held at the Law Society, London aims to help address these matters. The National Conference, sponsored by the Cardiff University Centre for Health and Social Care Law and the Law Society's Mental Health and Disability Committee draws on expertise from leading figures including Professor Richard Jones, Sophie Miles and Professor Peter Bartlett.
