Direct Payment extention 2009
On the 9th November 2009 significant changes were made to regulations governing Direct Payments. New regulations came into force which extends Direct Payments to people who lack capacity to consent and to people with mental health problems that are subject to mental health and certain criminal justice legislation. This section contains links to information reflecting these changes.
On October 29th 2010 an amendment was made to the 2009 Direct Payment Regulations which has made it necessary to revise Paragraph 119 of the 2009 Direct Payments Guidance. The change has been made to remove an anomaly which has resulted in local councils being required to carry out a financial assessment towards a short stay in residential care if a person is receiving direct payments, but not if temporary residential accommodation is directly provided by a local authority.
